Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Life Tab application ("App") provided by Quiet Summer LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Life Tab is a personal daily journal application that allows you to log photos, voice notes, videos, and text entries organized by date. The App provides calendar views, activity tracking, search, and location-based features to help you capture and revisit your daily memories.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. User Account

To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Content

You retain ownership of all content you create or add through the App ("User Content"), including photos, videos, voice notes, and text entries.

We do not collect your photos or media. Your photos and videos remain stored only on your device. We never transmit, upload, or access the actual image or video files. The App displays your content locally on your device—we do not store, process, or have access to your photo or video content on our servers.

You grant us only the limited rights necessary to provide the App's display and organization features on your device. We will not use your content for any other purpose without your explicit consent.

You agree that your User Content will not:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Contain malicious code, viruses, or harmful data
• Be used to harass, abuse, or harm another person

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's infrastructure
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems or bots to access the App
• Attempt to bypass any security measures

7. Intellectual Property

The App, including its design, features, code, graphics, and trademarks, is owned by Quiet Summer LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected. We are not responsible for any loss of data or content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIET SUMMER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately. You may request deletion of your account and data by contacting us.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App or on our website and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.

14. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Quiet Summer LLC, not Apple Inc.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of a failure to conform to any warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App or your use of it.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
